Iowa No-Fault
Iowa is a no-fault divorce state. This means that the parties may be granted a divorce without a focus on blaming either party for the dissolution of the marriage. The consequence of no-fault is that the requirements to file for divorce are relatively straightforward. Either spouse may file for divorce in Iowa.
There are certain rules that apply before you can file for divorce in Iowa such as if your spouse is not a resident of Iowa, you must have lived here for the past year. There must be a breakdown of the marriage that cannot be reconciled. There are other rules and I will explain those to you when you call me.
Simple Divorce
If you and your spouse can agree to resolve all issues, getting divorced can be simple. The following factors would lead to your obtaining a simple divorce.
- There are no minor children
- You agree on how property and debts are divided
- Neither spouse is seeking spousal support (alimony)
- Both spouses agree that the marriage is over

Contested Divorce
If there are contested issues in a divorce such as having minor children, the divorce will most likely require a greater amount of work. You will be required to fully disclose all relevant financial information. Depending on the extent to which you can agree or disagree on a divorce settlement, we can present the stipulated agreement to the court; engage in mediation, or proceed to a full trial.
